The online store is not obliged and does not have the objective possibility to control how users use the provided services.
  4. SHOPPING 4.1. Shopping in the online store can be done in several ways: Shopping with user registration by creating a user profile – the order information includes a list of ordered products, user names, contact phone number, and delivery address or contact. By registering, the user actively chooses to accept these General Terms and Conditions. Shopping without registration – the order information includes a list of ordered products or services, user names, contact phone number, and delivery address or contact. When making a purchase without registration, the user is required to accept these General Terms and Conditions with each order.

4.2. By placing an order through the online store, the user (buyer) agrees to express their desire to purchase the respective product/service from the seller against payment, either over the phone or via email. The online store will send you a notification of the registered order in its system, which does not imply acceptance, confirmation, or an obligation to fulfill it.

4.3. The distance purchase and sale agreement between the seller and the buyer is considered concluded at the moment when the user receives confirmation of the purchased service via email or receives a phone call from an employee of the online store confirming the purchased service.

4.4. The purchase and sale agreement between the user (buyer) and the seller consists of these general terms and the information provided by the user on the online store’s website.

4.5. Ownership of the ordered products and services will be transferred to the buyer upon their delivery or fulfillment, after the buyer has made the payment. The delivery of the ordered products and services will be confirmed by the buyer’s signature on the transport or financial document provided by the courier or in-person at the seller’s location.

4.6. The user is responsible for ensuring that all order details they have provided are accurate, complete, and up-to-date at the time of order submission.

4.7. Order Cancellation: The user has the right to cancel the ordered product/service only if:

  • The product or service clearly does not correspond to what was requested for purchase by the user.
  • The product and/or its packaging has been damaged during transportation, affecting its normal use. The user should sign a damage protocol in the presence of the courier and promptly inform the seller via the provided contact phone numbers or email.

A user who is a consumer within the meaning of the Consumer Protection Act has the right to withdraw from a distance contract for the purchase of goods or services without specifying a reason and without owing compensation or penalty, and without using the product or service within 14 days from the date of receiving the goods or confirming the service.

If the user wishes to exercise their right of withdrawal within the aforementioned period, they should send a withdrawal statement and return the product or refuse the service, filling out the necessary withdrawal and complaint form.

The withdrawal statement should be sent to the online store, and the user is obligated to keep the received product, ensure its quality and safety, and return it to the seller intact, in its original packaging provided by the manufacturer, including all accompanying documents such as user manuals, conformity declaration, warranty card, etc., without any external or internal defects. The costs of returning the product or service are borne by the user.

Upon receiving the returned product and inspecting it, the seller will refund the user the amount paid, no later than 14 days from the date on which the user exercised their right of withdrawal. In case the user made a payment by card, the respective amount will be refunded to the user’s card account.

If the user has purchased a service and has used any part of it, they cannot claim a refund of the amount spent. This decision is made voluntarily by the seller.

Any user can choose to replace the product with another product or service of equal financial value, subject to prior approval by the seller, with transportation costs borne by the buyer.

The seller reserves the right to request compensation for damaged or missing packaging, impaired appearance, missing parts of the complete set, or if the product is not in the condition in which it was sent or if the withdrawal is refused altogether.

Failure to comply with the terms and conditions of an electronic contract with delivery for no valid reason shall be considered an abuse of trade rules on the part of the buyer.

In the case of a purchased service, the customer has the right to transfer it to third parties after prior notification by email or in-person at the seller’s location and after obtaining approval from the seller, provided that the service has not been used, and the third party has provided and filled in the necessary documents.

4.8. COMPLAINTS For actions related to complaints about a product, the user must notify our representative (via the Contacts button or by completing a complaint form) within 5 (five) business days and complete a complaint form. Complaint forms will be processed within 14 calendar days.

When submitting a complaint, the user must attach a cash receipt and/or invoice and provide additional details.

Upon acceptance of a complaint by the user, a document will be issued containing the date, the registration number of the complaint, the type of product or service, and the person who accepted the complaint.

If the user accepts the package or service without any external or packaging-related remarks, any subsequent claims regarding these issues will be considered baseless and will not be satisfied.

In case a damage protocol is not prepared and signed in the presence of the courier upon receiving the package, the user loses the right to claim external visible defects in accordance with the subject of the transaction.

If, due to the seller’s fault, there is a discrepancy between the ordered and received products, the user can request an immediate replacement of the incorrect product with the correct one from the order within 3 days from the date of receipt, with a notification to the online store. In this case, the user needs to return the product through the courier service specified by the seller, with the associated costs covered by the seller. The seller is obligated to deliver the correct products, at their expense, within 3 days of receiving the incorrect products.

The discrepancy of one of many products and services does not constitute a reason for refusing all of them.

The seller has the right to withhold the refund amount in cases of contract cancellation until the sold items are received or until evidence of shipment is provided, whichever occurs earlier.

In the event that the buyer has purchased a service, they have the right to raise complaints only during or immediately after the service is provided during their first visit to the medical center.

The seller may refuse a service complaint if the buyer has not complied with the requirements for informed consent before or after the service has been provided.

In the case of a delivered defective product, the seller will replace it with the same product at their own expense or refund the purchase amount.

For approved service complaints, the seller is obliged to repeat the procedure, replace it with another of the same value, or refund the amount.

4.9. CANCELLATION OF ORDERS The seller has the right to refuse to fulfill (cancel) an order made by the user, and they must notify the user accordingly.

The cancellation of the order does not entail any responsibility or subsequent obligation on either party towards the other, and, consequently, neither party has the right to seek compensation for the cancellation, in cases where:

  • The data provided by the user is incomplete and/or incorrect.
  • The seller does not make contact with the user and does not confirm the order.
  • The user abuses good commercial practices and applicable legislation.
  • The user has used a portion of the purchased product or service.
  • The user has misled medical personnel during surveys and consultations.
  1. PAYMENT 5.1. The prices of products and services advertised on the online store are final and include all necessary taxes and fees according to the type of service or product, as well as any other taxes required by Bulgarian legislation.

5.2. The payment methods available are:

5.2.1. Cash on delivery. 5.2.2. Bank transfer to the account of MЦ БЕЛИСИМО КЛИНИК ООД. 5.2.3. Debit or credit card payments: Visa/Visa Electron, MasterCard, or Maestro, used for transactions.

5.3. The user must provide all necessary information for issuing an invoice in accordance with current legislation. The seller will issue an invoice for the products ordered and delivered to the user based on the information provided by the user.

In order to correctly create an invoice for the specific order, the user must continually update the information in their profile/account on the online store. The user must verify the information provided in their order, ensuring that all data is complete, accurate, and correct. The seller issues an invoice for each payment if the user explicitly specifies this in the order. The user will receive the invoice either physically, together with the ordered products, or electronically, sent to the email address provided by the user.
